S P Setia’s Personal Data
and Privacy Policy
S P Setia Berhad, S P Setia Group, and/or our subsidiaries (“S P Setia”, “we”, “us” or “our”) view and treat your Personal Data seriously.
We are committed to complying with the Personal Data Protection Act 2010 (“PDPA”), and we have therefore developed a Privacy Policy that guides how S P Setia collect, process, use, disclose, transfer and store your Personal Data. Kindly study this Policy and understand your rights on the matter.
Collection and Use of Personal Data
Your Personal Data is information in our possession that relates directly or indirectly to you, to the extent that you can identified or identifiable from that information or from that and other information in our possession. The Personal Data that we collect may also include sensitive personal data which means any personal data consisting of information such as your physical or mental health or condition, your political opinions, religious beliefs or other beliefs of a similar nature, biometric data, the commission or alleged commission of any offence by yourself, or any other personal data as the Minister may determine.
We may obtain your Personal Data from yourself and from a variety of sources, including but not limited to: –
- Indirectly from agencies established by regulatory authorities, operators of registers or databases available to the industry, other external database suppliers, governmental departments, agencies or authorities, licensed credit reporting agencies, any party who has, does or will provide products or services to you and to whom you have granted consent, our commercial partners, or related persons or organizations from whom such information would be essential for the proper processing of the data within the purpose as stated herein; and
- Directly from you when you submit registration forms (either electronic or printed) relating to any of our products (new launches or property roadshows, showcases, exhibitions or any other promotional events) or services, register for or use any of our services on websites or mobile applications, use or purchase our services or products, enter into or make payments related to any transactions with us, interact with our customer service officers, participate in our contests, events and market surveys or research.
In addition to the above, we may use a variety of technologies, to automatically collect information about your activities on our website(s) and/or mobile application(s) (if any), such as web beacons, clear pixels or pixel tags, analytical tags, geo-location technologies and quick response (QR) code.
Personal Data that S P Setia may collect
When you transact with S P Setia, we may collect a variety of your Personal Data, which may include amongst others your: –
- a. Name;
- b. National registration identity card / Passport number;
- c.Photocopy of National registration identity card / Passport;
- d. Gender;
- e. Marital status;
- f. Race and religious beliefs;
- g. Nationality;
- h. Postal address;
- i. Telephone number;
- j. Email address;
- k. Medical information;
- l. Fingerprint, photographs or other images;
- m. Salary range and Information relating to your Employment / name of Employer;
- n. Contact preference; and
- o. Credit card or bank account information and your credit history.
The list of Personal Data stated above is not exhaustive and may include other Personal Data depending on the nature of dealings or transaction with S P Setia.
Under certain circumstances, you may also be required to provide the personal data concerning other individuals for the purposes of your transaction with S P Setia and you hereby warrant and acknowledge that where you provided such data, you have obtained the consent of such individuals. If you are under the age of 18 years, you confirm that you have obtained your parent or guardian’s consent to provide your Personal Data to S P Setia.
How S P Setia uses your Personal Data
The Personal Data (including sensitive personal data) collected from you in the course of your relationship with us is being, and will continue to be processed for the following purposes and any other incidental purposes, including but not limited to: –
a. the delivery of notices, provision of services or products and the marketing of such services or products, whether present or future, to you;
b. in order for you to enter into the necessary agreement and/or contract to purchase the products and/or properties from us (for real estate customers only), or to enter into tenancy, event management and other agreements or venue bookings with us;
c. assisting with bank loan or housing mortgage and financing application;
d. managing and servicing our relationship with you and providing you with better customer service, including user or customer relationship management procedures;
e. those purposes specifically provided for in relation to any particular service or product offered by us;
f. conducting marketing and client profiling activities in connection with our services and related products;
g. conducting credit assessments and financial and other background checks of users as we may determine to be necessary or appropriate;
h. our internal record keeping, reporting and audit purposes;
i. collection of outstanding payments from clients;
j. prevention of crime (including but not limited to fraud, money-laundering, bribery);
k. meeting any legal or regulatory requirements relating to our provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us or any member companies of our Group;
l. purposes relating to any of the above (including but not limited to research, benchmarking and statistical analysis);
m. enable us to send you information by e-mail, telecommunication means (telephone calls or text messages), social media or any other mode of communication as may be available from time to time, about products and services offered by selected third parties that we think may interest you but in doing so we maintain control over your Personal Data and we will not disclose your Personal Data to such third parties without your prior consent;
n. vacant possession, keys handover, property/estate management, customer care and/or defect rectification works;
p. post vacant possession services, such as club house services, security and customer loyalty programmes;
q. provide access to our properties or facilities within our properties;
r. enable us, our service providers, contractors or any applicable property owner to undertake property management, maintenance and/or repairs;
s. maintaining and developing our business systems and infrastructure; and
t. for data transfer to, and sharing with, other members of the S P Setia Group and/or third parties acting on our behalf, including those located outside Malaysia.
Please note that it is necessary for us to collect and process your Personal Data. If you do not provide us with your Personal Data, we will not be able to effectively provide services to you or process your Personal Data for any of the above purposes, if at all.
In processing your Personal Data for the above purposes, please note that we may transfer and further process your Personal Data outside of Malaysia. We will ensure the personal data transfer complies with the PDPA and the recipient jurisdiction affords similar levels of data protection safeguards as the PDPA.
Protection of Personal Data
S P Setia takes the necessary precautions, both administrative and technical to safeguard your Personal Data against loss, theft, misuse and unauthorized access, disclosure, usage, alternation or destruction.
Retention of Personal Data and Access
S P Setia shall endeavour to make it easy for you to keep your information accurate, complete and up to date. We will retain your personal data for the period necessary to fulfill the many different purposes outlined in this Privacy Policy unless a longer retention period is permitted or required by law.

For other personal information, we make good faith efforts to provide you with access so you can request that we correct the data if it is inaccurate or delete the data if S P Setia is not required to retain it by law or for legitimate business purposes.
We may decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law.
